This Privacy Notice (“Notice”) applies to consumers who use, as applicable, the websites, online services, or other services (collectively, the “Services”) of Alliance Entertainment, and its subsidiaries and affiliates (collectively, “AENT”, “we”, “us”, or “our”).

By using, accessing or registering with the Services, you acknowledge this Privacy Notice and agree to our Terms of Use.

For the purposes of this Privacy Notice, "Personal Information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you. Personal Information does not include information that is publicly available (unless otherwise provided by law), or information that is de-identified, or aggregated so that it does not allow an individual to be identified directly or indirectly.

The Personal Information We Obtain And Manage

The Personal Information that we may collect includes, but is not limited to:

  • Contact information such as email and postal addresses, date and month of birth, and telephone numbers;
  • Financial information; and
  • Purchasing activities.

How We Obtain Personal Information

We may obtain your Personal Information from the following sources:

  • Information that you directly provide to us when you initiate communications with us, subscribe to our newsletter, respond to a survey published by us, purchase Services from us, or otherwise communicate with us;
  • Your entries for sweepstakes and other promotions provided or sponsored by us;
  • From other parties, including other consumers if they ship you a gift; and
  • Through tracking technology vendors, such as cookies and other tracking technologies.

We may collect or purchase Personal Information from third parties including data brokers and lead generators for our marketing purposes, in compliance with applicable law. This Personal Information may include, but is not limited to, individual names, email and postal addresses, and telephone numbers.

How We Use Your Personal Information

We use Personal Information for the purposes described in this Notice. Specifically, we use your Personal Information for:

  • Doing business with you, including processing payments and communicating with you regarding your purchases;
  • Communicating with you regarding sweepstakes and other contests offered or sponsored by us that you have entered;
  • Processing, formatting, and displaying customized content on the Services;
  • Communicating with you regarding changes to our Terms of Use, this Privacy Notice or any other policies or terms relating to the Services;
  • Auditing, researching, and analyzing in order to maintain, protect and improve the Services offered or provided by us; and/or

Our Services, including any phone or website chatbot functionality, may use experimental technology, including generative artificial intelligence (collectively, “AI Services”), and may sometimes provide inaccurate content. Any information provided to our AI Services may be used to continuously train the AI Services. Do not provide sensitive Personal Information or confidential or proprietary information when using the AI Services.

Some technologies used on our Services allow us and our service providers to monitor and analyze how visitors use our Services to better understand user behavior and improve our Services. When you interact with us online, information related to your behavior may be collected by us and our service providers. Disclosure Of Personal Information

We may disclose your Personal Information in the following circumstances:

  • Vendors. This includes other parties that help us provide the Services, such as service providers supporting our IT infrastructure, customer support operations, analytics, payments, communications, and security.
  • Affiliates. These are companies that are related to or affiliated with AENT (collectively, “Affiliates”) and who may process Personal Information for the purposes mentioned in this Privacy Notice.
  • Other Disclosures. This includes the following circumstances:

    • To comply with a subpoena or other judicial order or process, or other legal process;
    • To enforce our policies, to investigate, prevent and take action regarding illegal activities or suspected fraud, or to protect our legal rights, property, or safety;
    • In the event we sell or transfer all or a portion of our business assets (e.g., further to a merger, reorganization, liquidation, or any other business transaction), including negotiations of such transactions, in accordance with applicable laws;
    • Where necessary to protect us, our affiliated companies, our employees, our customers, or others.

Cookies And Other Tracking Technologies

We and our vendors may use a variety of tracking technologies, including cookies, beacons, and pixels that collect certain information when you interact with the Services. Depending on your device and browser settings, these tracking technologies may collect your IP address, device identifiers, user preferences, approximate geolocation, the pages you click on, and the website you visited immediately beforehand. Additionally, these technologies may collect details about how you interact with the Services. We may use these technologies for various purposes, including to provide functionality to the Services, help us route traffic between servers, understand how the Services are performing, how visitors use the Services, improve features and content on the Services, and for advertising purposes. We may combine certain information collected through tracking technologies with other information we obtain about you, which may include information we obtain from our vendors. We or other parties may collect Personal Information about your online activities over time when you use the Services.

Technologies we use may include, but are not limited to:

  • Meta. Meta may use cookies, web beacons, and other storage technologies, including the Meta Pixel, to collect or receive information from the Services, and elsewhere on the Internet and use that information to target and deliver ads.

    In some cases, we may integrate the analytics services we use with certain advertising services that are also made available by our analytics providers. For example, we integrate Google Analytics with the following Google advertising features:

    • Remarketing with Google Analytics
    • Cross Device Remarketing & Reporting
    • Google Analytics Demographics & Interest Reporting
    • Google Display Network Impression Reporting

    You can opt-out of Google Analytics advertising features directly with Google through its Ads Settings, Ad Settings for mobile apps functionality, or downloading the Google Analytics Opt-out Browser Add-on.

Certain advertising tracking technology vendors may participate in the Digital Advertising Alliance (“DAA”) AdChoices Program and may display an Advertising Option Icon for Interest-based Ads that links to an opt-out tool which allows you to exercise certain choices regarding targeting. Please be aware that, even if you are able to opt-out of certain kinds of interest-based ads, you may continue to receive non-targeted ads.

We are not responsible for the effectiveness of, or compliance with, external-parties' opt-out options or programs or the accuracy of their statements regarding their programs.

Sweepstakes, Contests, And Promotions

We may operate sweepstakes, contests, raffles, and similar promotions (each, a “promotion”), including promotions that are jointly sponsored or offered by other parties. Participating in a promotion may require submitting Personal Information. If you choose to participate in a promotion, your Personal Information may be disclosed to the parties as described in the terms applicable to that promotion.

This Privacy Notice only pertains to the Services. Other websites and portals, such as those to which the Services links may have their own privacy policies. We encourage you to read the privacy policies and terms of use of the websites and portals that you visit through links placed on the Services as well as those for websites that provide links to the Services. You should contact these websites directly if you have any questions about their use of your Personal Information. We are not responsible for any use of your Personal Information or any other type of your information when you use such third party sites and services.

Your Choices

You have certain choices over your Personal Information.

  • You may update certain Personal Information by logging into your account.
  • If you have opted-in to our texting program, reply “stop,” “unsubscribe,” “cancel,” or a similar term to opt-out.
  • If you signed up to our email marketing communications, you may opt-out at any time by clicking the unsubscribe link in the body of the email. If you have a registered account, you may also control your email marketing preferences through your account settings. Please allow up to 10 business days for your request to be processed. Note that regardless of your email marketing preferences, we may still send you program emails for administrative reasons, including transactional emails about your account or any Services or products you have requested or received from us.

Children's/Minor's Use Of The Services

Our Services are not intended for children under 18. If we learn that we have received information directly from a child who is under the age of 18, we will delete the information in accordance with applicable law.

We may also use the above categories of Personal Information for the following purposes:

  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about AENT users is among the assets transferred;
  • To help maintain the safety, security, and integrity of our products and Services, databases and other technology assets, and business; and
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.

Retention of Personal Information

We keep your Personal Information for as long as is necessary for the purposes described in this Notice, which generally means holding your Personal Information for as long as one of the following apply:

  • Your Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the Personal Information;
  • Your Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was collected; or
  • We are otherwise required or permitted to keep your Personal Information by applicable laws or regulations.

Selling or Sharing Personal Information for Cross-Context Behavioral Advertising and Targeted Advertising

We may sell or share identifiers, commercial information, internet or other electronic network activity, geolocation data, and identifiers to our advertising and marketing partners, data analytics providers, and social networks for our cross-context behavioral advertising and targeted advertising.

Your Privacy Rights

Residents in the United States, including California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, may have certain data privacy rights. Subject to certain limitations, you have the following rights:

  • Access

    You have the right to confirm whether we are processing your Personal Information and to access the Personal Information we have collected about you.

    California residents specifically have the right to know:

    • Our business or commercial purpose for collecting, selling, or sharing that Personal Information;

    If you are an Oregon or Minnesota resident, you have the right to receive a list of the specific third parties to whom we have disclosed Personal Information. If you are a Delaware resident, you have the right to request a list of the categories of third parties with whom we have disclosed your Personal Information. If you are a Maryland resident, you have the right to request a list of the categories of third parties with whom we have disclosed Personal Information.

  • Deletion

    You have the right to request that we delete your Personal Information, subject to certain exceptions.

  • Correction

    You have the right to request that we correct any of your Personal Information that we collected from you and retained, subject to certain exceptions.

  • Sales or Sharing for Cross-Context Behavioral Advertising or Targeted Advertising Opt-out Rights

    You have the right to direct us not to sell or share your Personal Information for cross-context behavioral advertising or targeted advertising. We do not knowingly sell or share the Personal Information of consumers under 18 years of age.

    In order to opt-out of cookie based sales or sharing for cross-context behavioral advertising or targeted advertising, click the “Do Not Sell or Share My Personal Information” link in the footer of the website. You may also exercise your right to opt-out of cookie based sales, sharing, and targeted advertising via an opt-out preference signal, such as the Global Privacy Control.     We do not use automated decision making technology or profile in a manner that would result in legally or similarly significant effects and as such do not offer a profiling opt-out right or a right to access or opt out of use of automated decision making technology.

    We will not discriminate or retaliate against you for exercising any of your privacy rights.

Authorized Agent

Depending on your state of residency, you may have the right to designate an authorized agent to make certain privacy rights requests on your behalf. Use the authorized agent request form.

Rhode Island

Rhode Island residents can receive the most updated list of third parties to whom we sell Personal Information.

Other California Privacy Rights

California's “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Services that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. If you are a California resident, you may opt-out of our disclosures to third parties for their direct marketing purposes by submitting a request to opt-out via our webform.

Canada Specific Disclosures

This section applies to the Personal Information of residents of Canada and supplements the other sections of this Privacy Notice.

Your Privacy Rights

You have the following rights with respect to your Personal Information, subject to limited exceptions set out in such laws:

Cross-border Transfers

We are based in the United States, and some of our affiliates and external third-party service providers are based outside of Quebec and/or Canada, including in the United States. The processing of your Personal Information will therefore involve a transfer of information outside of Quebec and/or Canada. Organizations based outside of Canada may not be subject to privacy laws that provide you with the same rights and protections as in Canada. As a result, when your Personal Information is used or stored in a jurisdiction other than where you are residing, it may be subject to the law of this foreign jurisdiction, including any law permitting or requiring disclosure of the information to the government, government agencies, courts and law enforcement in that jurisdiction.

Security of your Personal Information

We use commercially reasonable efforts to ensure that Personal Information is secure and to protect against its loss, misuses, and alteration. Although we follow reasonable procedures to safeguard Personal Information, transmission via the internet is not completely secure and we cannot guarantee the security of your Personal Information online. We restrict access to Personal Information to those service providers, employees, contractors and agents of AENT who need to access Personal Information for the purposes specified above. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination, if they fail to meet these obligations.

Information for Users Outside The United States

You acknowledge that the Personal Information you provide to us may be transferred and stored in the United States, regardless of your country of domicile. Please be aware that the data protection laws and regulations that apply to your Personal Information transferred to the United States or other countries may be different from the laws in your country of residence.

Changes to this Privacy Notice

We may, at our sole discretion, revise this Privacy Notice at any time in a manner consistent with applicable laws and regulations. When we revise this Privacy Notice, we will incorporate the revisions into this policy and will revise the “last updated” date at the top of this web page.
